These Terms of Service (“Terms”) govern your access to and use of the website at leeteracy.ai and the related applications and services (collectively, the “Service”) provided by Leeteracy (“Leeteracy,” “we,” “us,” or “our”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Eligibility and Accounts
To use the Service you must register for an account and provide accurate, complete information. If you are using the Service as part of a school, institution, or course, your access may be provisioned and governed by that organization. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us promptly of any unauthorized use.
Educator accounts require a valid invite code. You may not share, resell, or transfer your account or invite code without our authorization.
2. Acceptable Use
You agree not to:
- Use the Service for any unlawful, harmful, or fraudulent purpose;
- Upload content you do not have the right to use, or that infringes the intellectual property or privacy rights of others;
- Attempt to gain unauthorized access to the Service, other accounts, or our systems;
- Interfere with or disrupt the integrity or performance of the Service, including via automated scraping, denial-of-service, or reverse engineering;
- Use the Service to cheat, misrepresent academic work, or otherwise violate the academic-integrity policies of your institution;
- Resell, sublicense, or commercially exploit the Service without our consent.
3. Your Content
You retain ownership of the course materials, documents, responses, and other content you submit to the Service (“User Content”). You grant Leeteracy a worldwide, non-exclusive license to host, store, process, and use your User Content solely to operate, provide, secure, and improve the Service, including generating questions, grading responses, and delivering AI tutoring and analytics.
You are solely responsible for your User Content and represent that you have the necessary rights to submit it and grant the license above.
4. AI-Generated Content
The Service uses artificial intelligence to generate questions, explanations, grades, and tutoring responses. AI-generated output may be inaccurate, incomplete, or otherwise unsuitable, and should not be relied upon as professional, medical, legal, or academic advice. Educators are responsible for reviewing AI-generated content before relying on it for instruction or assessment. You use AI-generated output at your own discretion and risk.
5. Intellectual Property
The Service, including its software, design, text, graphics, and trademarks (excluding User Content), is owned by Leeteracy or its licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service in accordance with these Terms. No other rights are granted.
6. Privacy
Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. By using the Service, you consent to those practices.
7. Fees and Subscriptions
Certain features of the Service may require a paid subscription. Where fees apply, they will be described at the point of purchase. Unless otherwise stated, fees are non-refundable, and subscriptions may renew automatically until cancelled. We may change our fees on reasonable notice.
8. Suspension and Termination
We may suspend or terminate your access to the Service at any time, with or without notice, if you violate these Terms or if we reasonably believe your use poses a risk to the Service or others. You may stop using the Service at any time. Upon termination, the rights granted to you under these Terms will cease, though certain provisions (such as those on intellectual property, disclaimers, and limitation of liability) survive.
9. Disclaimers
The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that AI-generated content will be accurate or reliable.
10. Limitation of Liability
To the maximum extent permitted by law, Leeteracy and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising out of or related to your use of the Service. Our total liability for any claim arising out of or relating to the Service will not exceed the greater of the amount you paid us in the twelve months preceding the claim or one hundred U.S. dollars.
11. Indemnification
You agree to indemnify and hold harmless Leeteracy and its affiliates from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your User Content, your use of the Service, or your violation of these Terms or applicable law.
12. Governing Law
These Terms are governed by the laws of the United States and the State of Georgia, without regard to conflict-of-laws principles. You agree to the exclusive jurisdiction of the state and federal courts located in Georgia for any dispute arising out of or relating to these Terms or the Service, except where prohibited by applicable law.
13. Changes to These Terms
We may modify these Terms from time to time. When we make material changes, we will update the “Last updated” date above and, where appropriate, provide additional notice. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
